Since March 2024, the rules have changed. The Genuine Temporary Entrant | GTE test is gone — replaced by the Genuine Student (GS) requirement under Ministerial Direction 106. At the same time, refusals for onshore students breaching visa conditions are rising sharply. From 23 March 2024, all new student visa applications are assessed against the Genuine Student |GS requirement. Decision-makers now ask specific GS questions instead of requiring a 300-word statement.
They assess:
8202 – failing to maintain enrolment, progress, or attendance
8105 – working more hours than permitted | over 48 hours/fortnight during study terms
8516 – no longer meeting course or financial requirements
