Student Visa Refused? Don’t Lose Hope — Know Your Appeal Options

Since March 2024, the rules have changed. The Genuine Temporary Entrant | GTE test is gone — replaced by the Genuine Student (GS) requirement under Ministerial Direction 106. At the same time, refusals for onshore students breaching visa conditions are rising sharply. 🔎 Why Student Visas Are Being Refused

Refusals can occur offshore or onshore, and the reasons differ.

Offshore refusals – the GS requirement

From 23 March 2024, all new student visa applications are assessed against the Genuine Student |GS requirement. Decision-makers now ask specific GS questions instead of requiring a 300-word statement.

They assess:

Why you chose Australia and your course

How your course benefits your future

Whether your background supports your study choice

Any past visa history or previous study in Australia

Academic progression inconsistent with past studies

Common GS refusal reasons:

Weak or generic answers that don’t prove genuine study intent

Financial evidence not meeting standards

Low English test scores

ncomplete or inconsistent documents

Onshore refusals – breaching visa conditions

For students already in Australia, refusals often happen when the Department finds visa condition breaches. These can lead directly to refusal or even cancellation.
Typical breaches include:

8202 – failing to maintain enrolment, progress, or attendance

8105 – working more hours than permitted | over 48 hours/fortnight during study terms

8516 – no longer meeting course or financial requirements

👉 If DHA believes you breached these conditions, your application may be refused — and future options can be limited.

⚖️ Options After a Student Visa Refusal

If your application was refused onshore, you may have the right to appeal. Lodging within the strict timeframe (often 21 days) usually keeps you on a bridging visa until a decision is made.
Where appeal rights don’t apply (e.g. offshore refusals), a new application can be lodged with stronger GS answers and improved documentation.
If there was a legal error in the decision, Visa Advisor works with external lawyers to prepare a court challenge.
If the study is no longer viable, you may still qualify for a partner visa, skilled visa, or regional pathway.

🚨 Important July 2024 Change

From 1 July 2024, applicants on a Visitor visa or a Temporary Graduate (485) visa can no longer apply for a student visa onshore. They must apply from offshore. This makes it even more critical to avoid refusals while in Australia.
