Privacy Policy
How we collect, use, hold, disclose and protect your personal information.
1. Introduction
Visa Advisor Pty Ltd (ABN 48 684 870 415, MARN 0852408) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, hold, disclose and protect your personal information when you use our website, complete our forms, book a consultation, or engage our migration services.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
2. Information We Collect
We may collect: your name, contact details (email, phone), country of citizenship and residency, visa and immigration history, occupation and qualifications, family details relevant to your matter, payment information processed by our payment provider, and information you provide through our website forms, the free Eligibility Check, consultations, and correspondence.
Sensitive information. To provide migration services, we may need to collect sensitive information, such as health information, criminal history, details of your relationships, and information contained in identity documents. We collect sensitive information only with your consent and only where it is reasonably necessary for your matter.
3. How We Use Your Information
- To assess your eligibility and provide migration advice and services.
- To respond to enquiries and schedule and deliver consultations.
- To process payments and issue tax invoices.
- To meet our professional and record-keeping obligations under the OMARA Code of Conduct.
- To send service updates and, where you have consented, marketing communications.
Automated tools. We use software, including artificial intelligence tools, to help review information you submit through our Eligibility Check and other forms, and to prepare draft assessments and documents. The information used can include your visa and immigration history, occupation, qualifications, work history, age, English test results, and family details. A registered migration agent reviews every assessment before any advice is given to you or any decision is made about your matter.
4. Data Retention
We keep your file for at least 7 years after the last action on it, as the OMARA Code of Conduct requires, and securely destroy it after that unless the law requires us to keep it for longer.

To provide the services you have engaged us for, we disclose your personal information to the Department of Home Affairs, the Administrative Review Tribunal, skills assessing authorities, state and territory nomination bodies and, where relevant, your sponsor or nominating employer. If you were referred to us, we tell the person or business that referred you your name, whether you engaged us, the fee on which their referral commission is calculated, and when your application is lodged, and only with your written consent. We also disclose information where the law requires it, including in response to a notice from the Office of the Migration Agents Registration Authority (OMARA). Otherwise, we keep your information confidential as the OMARA Code of Conduct requires.
