Australia has changed how visa refusal reviews are handled by the Administrative Review Tribunal (ART)

If you’re appealing a student visa or other temporary visa refusal, many cases are now decided on the papers only meaning no hearing at all

This applies to both new and some existing cases

Here’s a clear breakdown. 

What does “paper-only review” mean? 

paper-only review means: 

  • The Tribunal decides your case only on written documents 
  • ❌ No online hearing (Zoom / Teams) 
  • ❌ No phone hearing 
  • ❌ No in-person hearing 
  • You cannot appear before the Tribunal 
  • Everything depends on:  
  • Written submissions 
  • Evidence 
  • How well your case is prepared on paper 

Documents are still uploaded online, but the decision itself is paper-based

NEW ART applications (after the law starts) 

If you lodge a new appeal for certain temporary visas: 

  • ✅ Your case is paper-only 
  • ❌ No hearing 
  • ❌ No chance to explain things verbally 
  • The Tribunal decides only on documents 

This currently affects temporary visa refusals, especially student visas

EXISTING ART applications (already lodged) 

This is where many people get confused. 

Your case becomes paper-only IF: 

  • You lodged your appeal before, BUT 
  • The ART had not yet allocated a Tribunal Member to your case 

In that situation: 

  • ❌ You lose the right to a hearing 
  • ✅ The new paper-only rules apply

If before the new law started

  • An ART Member was already allocated to your case
